Finally, Canada passed legislation to implement the US Mexico Canada agreement (usmca), including new intellectual property provisions on patents and counterfeit goods.
The usmca replaces the North American Free Trade Agreement (NAFTA), which will enable the Canadian government to introduce compensation procedures for the delay in the grant of patents by the Canadian Intellectual Property Office. The procedure will be implemented within 4.5 years after the usmca is finally approved and becomes law.
For Canada, the term of copyright protection will be 70 years after the author's life and death, while the current term of copyright protection is 50 years after the author's life and death. This provision will be implemented within 2.5 years after the usmca becomes law.
The three countries will also set up an intellectual property committee composed of government representatives from each country to promote the exchange of information related to intellectual property matters, including how intellectual property protection can stimulate innovation, enhance creativity, promote economic development and increase employment opportunities.
The intellectual property committee will also focus on developing methods to reduce intellectual property infringement and effective strategies to eliminate potential infringement incentives.
In addition, suspected counterfeit goods that pass through Canada but are not shipped to that country will be seized and inspected at the Canadian border. The United States, Canada and Mexico are committed to strengthening intellectual property border enforcement by promoting customs cooperation and exchange of best practices.
NAFTA was signed by the United States, Mexico and Canada and implemented in 1994. It has been replaced by usmca.
